KANYE West claimed his ex Kim Kardashian can’t prove he wrote the social media posts attacking the star and her boyfriend Pete Davidson.
The 44-year-old has been feuding with Kim, 41, and Pete, 28, in recent months.
While Kanye’s social media has been full of threats and nasty comments targeted at the Keeping Up With the Kardashians alum and the Saturday Night Live star, the rapper is now claiming Kim can’t prove that he wrote the posts.
According to legal documents obtained by TMZ, Kanye is trying to make his social media posts attacking Kim, Pete, and others inadmissible in next week’s hearing about the reality star’s request to restore her single status.
He argued that Kim can’t prove he penned any of his social media posts, while his lawyer claimed the posts are “double hearsay.”
The attorney said: “Kim claims she read something online allegedly by Kanye and characterizes the posts in her declaration as misinformation … Kim needed to offer the social media posts into evidence, and show that the posts were written by Kanye.”
The legal documents never state that Kanye didn’t write the post, though argued Kim hasn’t done the work to prove he wrote them.
VALID PRENUP?
Kanye’s lawyer also claimed their prenup can’t currently be viewed as valid, arguing there’s a presumption in California that prenups signed after 2001 are invalid.
He also said the only way the prenup can be validated will either be during a trial or if both Kim and Kanye agree to it.
Based on the lawyer’s argument, it seems Kanye believes the prenup isn’t valid and he doesn’t want it to be enforced until there’s a full-blown trial.
Kanye’s insistence that the prenup is not valid will cause major delays in Kim’s attempt to become legally single.
KANYE’S OBJECTIONS
Earlier this month, Kanye responded to Kim’s petition to regain her single status and he is not okay with the move.
TMZ reported the Grammy winner’s lawyer objected his ex’s order out of concerns that Kim may move some of their assets to her separate accounts if she decides to remarry.
Kanye has reportedly accepted Kim’s plea to be legally single, but only under certain conditions.
The hitmaker first demanded that both parties get paid out any remaining balance owed if either of them dies.
He also said he wants to block his ex from transferring assets out of any trust they created together.
Additionally, Kanye wants Kim to waive their marital privilege pending a custody decision for their four children.
He also requested that all communication between the pair be used as court record and that spousal privilege be waived if she is to wed again.
Kanye’s lawyer claimed that Kim rejected Kanye’s requirements.
ATTACKING PETE
Kanye’s most recent filing comes after he slammed Pete in a new Instagram diss.
The entertainer claimed he had “ran Skete off the gram” when the comedian temporarily deleted his account.
Kanye shared a snapshot and posted an empty profile of The Suicide Squad actor’s Instagram, which was captioned: “No posts yet.”
He continued mocking him: “Tell your mother I changed your name for life.”
Despite Kanye’s claims, a source told Page Six that the comic’s temporary absence from Instagram had nothing to do with Kim’s ex.
The insider said: “Pete deleted his IG because immediately after his first post he started receiving a flood of messages, both positive and negative, reminding him why he didn’t want social media to begin with.
“[Pete] is in the middle of several big film projects and wants to continue to stay very focused on his work and the positive things happening in his life.
“Kanye didn’t drive Pete off social media.”
Kanye also previously called Pete a “d**khead,” accused him of “destroying” their family and threatened to “beat his a**.”
